Equity and Diversity: Defending the Right to Education for the 21st Century

This policy brief, published by the Education Law Center, discusses how education policies can inadvertently deprive students of their educational rights by creating inequitable school funding and through segregative district and school assignments. The author establishes a constitutional education framework and delineates significant barriers to achieving equity and diversity in schools. The report offers a set of foundational strategies to address these challenges and recommends that state leaders design policy that provides three outcomes: (1) cost-based, weighted student funding; (2) universal, high-quality early education; and (3) need-based financing for school buildings to establish equitable and diverse schools.
